excuse me, if the ladder was turned toward the balcony rail it would be cool w/ osha but still be weaker because there's no middle support. from an engineering standpoint it appears to be ok so long as the knots are secure.

I wouldn't worry so much about the knots (and btw, it looks like he's using a strap with a hook woven onto the end to fasten to the ladder rungs).  I'd be more concerned with just how solidly the banister is fastened to the floor.  And then there's the fact that this is one of those four-section 'configurable' ladders so I don't know if I'd completely trust the joints that permit it to be folded, either.
